Current law, sources and limits of the cost schedule

Current law. Code civil: double jus soli (art. 19-3, child born in France to a parent who was also born in France) and acquisition of nationality at majority for a child born in France to foreign parents, with residence (art. 21-7). Special regime in Mayotte: since the act of 12 May 2025, both parents must have resided lawfully in France for at least one year at the time of birth (only one if parentage is established only with respect to that parent). The Constitutional Council upheld it with a reservation, and the implementing texts were published in May 2026.

Horizon. Not applicable.

Limits. No static budgetary effect. Abolishing the droit du sol (birthright citizenship) nationally would probably require a revision of the Constitution: the Constitutional Council accepted the Mayotte regime only because of the « spécificités » [“specific characteristics”] of that territory. Articles 19-3 and 21-7 of the Civil Code are cited without a link to the text (Légifrance was not accessible during the research). The date of the law differs between sources (12 or 13 May 2025: date of the law or of its publication in the JO, the official journal).

How to read these amounts. These are static costs and revenues, with no feedback effect, over a full year: nothing on growth, employment or the revenue that economic activity would gain or lose. A higher net cost does not on its own make a worse policy, nor net savings a better one: each programme rests on an economic model (demand-led stimulus, lower compulsory levies, consolidation of the public accounts…) that the cost schedule does not settle. GDP itself measures a volume of activity, not well-being or the usefulness of what is produced. Economic models and feedback effects.
